RSD - CRPS Attorney
A crippling condition that is difficult to prove requires an attorney with experience.
RSD/CRPS (Reflex Sympathetic Dystrophy/Complex Regional Pain Syndrome) cases are extremely complex cases to pursue. There is often no clear relationship between the event and the symptoms that follow. Proving that the condition was caused by the negligent party is usually one of the most important aspects of the case. However, intensive examination of the medical records and the benefit of opinions from medical experts can significantly increase the likelihood of success in proving that the accident/trauma was a factor in the presence or worsening of the condition. Many types of trauma can result in a claim for RSD/CRPS. Below is a summary of the condition and the standards used by some medical doctors in providing expert legal opinions. We hope you find it useful.

CRPS-1 (Reflex Sympathetic Dystrophy)-Cases wherein the nerve injury cannot be immediately identified.
Reflex Sympathetic Dystrophy (RSD or RSDS) also known as Complex Regional Pain Syndrome (CRPS) is a continuing pain syndrome that is usually accompanied by severe burning pain, extreme sensitivity to touch, extreme sweating, swelling, and discoloration of the skin. Unfortunately, no laboratory test can prove the presence of the condition and so the opinions of the treating doctors are extremely important.
The International Association for the Study of Pain has set standards or factors for diagnosing the condition. They are listed below.
CRPS-1 (Reflex Sympathetic Dystrophy)-Cases wherein the nerve injury cannot be immediately identified.
- An initiating noxious event or a cause of immobilization.
- Chronic pain, allodynia, or hyperalgesia which causes pain which is much greater than expected given the initial event.
- Proof of swelling, changes in blood flow, or abnormal sudomotor activity where the pain is located.
- Conditions that would explain the pain and other symptoms may exclude the diagnosis.
Note: Criteria 2-4 must be present.
CRPS-2 (Causalgia)-Cases wherein a distinct significant injury to a nerve occurred.
- Chronic pain, allodynia, or hyperalgesia following an injury to a nerve.
- Proof of swelling, changes in blood flow, or abnormal sudomotor activity where the pain is located.
- Conditions that would explain the pain and other symptoms may exclude the diagnosis.
Note: All three criteria must be present.
Causes of RSD/CRPS
CRPS and RSD are often the result of an injury suffered in an accident that results in nerve damage. Usually, the initial injury is to an arm or leg.
If we can prove that the condition was caused by or aggravated by an accident, compensation may be obtained from the responsible person.
